Recently, the Ministry of Environment, Forest and Climate Change implemented the applicability of EPR for Used Oil in India on 1st April 2024.
The CPCB has mandated every entity associated with the import, and manufacture, of Lubrication Oil, or Base Oil to obtain EPR for Used Oil registration within 6 months from the commencement of the Rule.
The EPR on Used oil is applicable on all types of used oil categories listed under the following HS Code- 2710 1972 to 27101990
Other Lubricant Oils falling under – 2710 9100, & 2710 9900
The Concept of Used Oil
The CPCB has defined the applicability of EPR for Lubrication Oil, Base Oil, and Used Oil under Rule 3 of the Hazardous Waste Management Rule, 2016.
The Sub Rule 36 of Hazardous and Other Waste Management Rules, 2023 considers the following oil categories as Used oil.
It includes-
Used oil derived from crude oil or a mixture of synthetic oil that includes:
1. Spent Oil
2. Used engine oil
3. Gear Oil
4. Hydraulic Oil
5. Turbine Oil
6. Compressor Oil
7. Industrial Gear Oil
8. Heat Transfer Oil
9. Sludges derived from the bottom of the Transformer Oil tank
According to CPCB, EPR for Used Oil applies to certain categories of oil waste that include:
1. Polychlorinated Biphenyls
2. Lead
3. Arsenic
4. Cadmium
5. Chromium
6. Nickel
7. Polyaromatic Hydrocarbons
Applicability of EPR for Used Oil Management
The EPR for used oil applies to the following handlers of used oil
- Producers and Manufacturers
- Importers
- Import of Base Oil Stakeholder
- Lubrication Oil Stakeholder
- Waste Oil Collector and Recycler
- Distribution and Retailer
Key Compliances Associated with EPR for Used Oil Management
- Every Producer must obtain an EPR for Used Oil Registration Certificate through the online CPCB portal only.
- The respective entities must fulfill their EPR Targets applicable on EPR for Base Oil for each FY.
- Registered Producers must share contact details through the CPCB website to initiate the Oil Waste collection process.
- Respective Producer, Collection Agent, Importer, and Recycler must file Annual and Quarterly Return by using the online EPR portal within the deadline.
- Respective Collection Agents must collect used oil from producers of oil waste and supply it to recyclers or Producers.
- Concerned Recyclers must recycle Used Oil for further treatment as per EPR for Base Oil Management Guidelines.
